On the verge of being exposed for the imposition of its communist puppet as Guatemala’s president, the Joe Biden regime’s State Department (DOS) has this week shown its contempt for law and Congress. Assistant Secretary for Western Hemisphere Brian Nichols has referred to Guatemala’s Prosecutor General’s Office (PGO) legal opening of electoral boxes from the June 25 election as “chilling” and “antidemocratic.”
These allegations add to earlier false charges, repeated by House Foreign Affairs Committee (HFAC) Chairman Michael McCaul in a July 14 press release. The PGO replied to McCaul on September 12 with a list of DOS crimes, challenged him to investigate, and offered complete cooperation.
To show good faith and consistency with House leadership weaponization investigations, McCaul should now investigate DOS’s new false accusations.
The PGO opened the boxes pursuant to a court-ordered search warrant stemming from a criminal complaint that the balloting had not been properly reported. Article 251 of Guatemala’s electoral law states: “Electoral crimes and misdemeanors are governed by the Guatemalan criminal code.” Article 251 of Guatemala’s constitution assigns criminal prosecution to the PGO.
Biden Special Advisor Juan Gonzalez, however, issued a melodramatic and deceptive statement in Spanish to Guatemala’s media: “We will take actions to defend the will of Guatemala’s voters, including the use of sanctions, suspending aid, and other tools”—as though enforcing the law relating to electoral integrity were contrary to the will of Guatemalans. The Biden regime is in effect saying it will punish Guatemala if it applies its laws and does not make DOS’s preferred candidate president.
DOS claims international observers all reported the election was properly run, but the observers are not qualified and lack legal authority to verify an election. Not only is there no way for the observers to see how the ballots and tally sheets are handled and the results reported, the institutions the observers represent are collaborating in the DOS fraud.
For example, Organization of American States officials openly supported the Semilla party. Its candidate, Bernardo Arévalo, has taken DOS pro-criminal positions. OAS Secretary General Luis Almagro has personally seen the voluminous evidence of Semilla registration fraud twice at the PGO, yet he will not acknowledge the PGO’s actions are consistent with the law and its obligations.
An election is an expression of a nation’s will, but only if it is carried out according to law. The Biden regime has no credibility in this considering state election laws in several swing states were openly violated in the 2020 election that brought Biden to power.
Those violations alone, never properly addressed, tainted the 2020 election. Just as then at home, the Biden regime is now characterizing as corrupt, antidemocratic extremists all Guatemalans who protest that the electoral authority violated the laws.
When the PGO opened the boxes, amply witnessed to ensure no tampering occurred, containing the ballots and original tally sheets, the latter were not there. That is criminal. The PGO must investigate and find those sheets and the people responsible for them not being where the law says they had to be.
The electoral authority’s crimes have now been verified for the public. The DOS reaction is to scream that those who correctly applied the law and opened the boxes are corrupt. Meanwhile, DOS continues to praise the electoral authorities that failed to keep the tally sheets in the boxes. This electoral crime negates the Guatemalan people’s will and belies the Biden regime’s claims of defending it.
The Biden regime is redoubling its efforts to deceive the public and intimidate opponents. President Lula of Brazil denounced a coup attempt in Guatemala against “the inauguration of the winner of democratic elections.” Biden helped in the fraud that installed Lula as Brazilian president. Lula has since worked with Xi Jinping to dislodge the US dollar as the world’s reserve currency. However, the Biden regime will look the other way so long as Lula helps a communist compatriot gain power in Guatemala.
The Biden regime’s globalist partners are uniting, as they did against a Ukrainian prosecutor in 2016, to intimidate a government into doing what they want. DOS arbitrarily and corruptly sanctioned Prosecutor General Consuelo Porras in 2021 and intervened openly in the selection process last year to prevent her reappointment because she had properly applied the law.
The United States under Biden and DOS stands for tyranny. They call criminals victims and law enforcement victimization. The House Judiciary, Oversight, and Ways and Means committees are investigating and exposing Biden regime’s weaponization of government, but HFAC supports US government weaponization against Guatemala.
Porras heroically stands alone against this weaponization because of her courage and dedication to the law. HFAC should investigate her documented charges of DOS criminality, inform the public, and correct DOS behavior.
This would have positive effects on other countries mistreated by DOS and other departments of the federal government that act as if Congress is a rubber stamp. House leadership should look at HFAC’s absence in the fight to expose the Biden regime’s weaponization of government and bring the committee to the fight.

During my DEA career, while stationed in Bangkok, Milan, and DEA’s Office of International Training (which included two trips to Guatemala), I had a lot of experience working with the State Dept. Even in the best administrations, there is a long-standing problem of culture in DOS. They think they are smarter and more capable than anyone else, and their arrogance is suffocating, to say the least.
Our recent experience in elections and misuse of our DOJ disqualifies us from judging the system of justice in Guatemala, whatever it is. We need to clean up our own back yard.
